These Terms and Conditions govern your use of the Recommend website and the services we provide. By engaging our services, you agree to be bound by these terms. Please read them carefully.
1. About Recommend
Recommend is a done-for-you video testimonial service. We conduct remote video interviews with your nominated clients and produce a suite of marketing assets including testimonial videos, case studies, social media posts, and supporting written content ("the Services").
2. Engaging Our Services
A service engagement begins when you submit an enquiry and we confirm acceptance in writing (email is sufficient). At that point, you agree to these Terms and Conditions in full. We reserve the right to decline any engagement at our discretion.
3. Your Responsibilities
By engaging our services, you agree to:
- Provide accurate information about your business and the client(s) you nominate for interview
- Obtain your client's willingness to participate before providing their contact details to us
- Respond to reasonable requests from our team in a timely manner to avoid delays
- Not use the delivered assets in any way that misrepresents the client's words or intent
4. Client Consent
We obtain direct consent from every interview participant before recording begins. By nominating a client for interview, you confirm you have their general agreement to participate. We handle all formal consent as part of our process. If a nominated client declines to participate, we will work with you to identify a suitable alternative.
5. Deliverables and Timelines
Delivery timelines begin from the date the interview is completed, not from the date of engagement. Estimated timelines are:
- Single video package: approximately 2 weeks after interview
- Three video package: approximately 3 weeks after final interview
- Five video package: approximately 4 weeks after final interview
These are indicative timelines. Delays caused by client availability, scheduling, or factors outside our control do not constitute a breach of these terms.
6. Revisions
Each package includes one round of revisions on written deliverables (case study, social posts, one-pager). Revision requests must be submitted within 14 days of delivery. Video editing revisions are limited to minor corrections; re-cuts or re-edits beyond the original brief may incur additional charges, which we will communicate to you before proceeding.
7. Payment
Payment terms will be specified in your invoice. We require full payment prior to delivery of final assets. Invoices not paid within the agreed terms may result in a hold on delivery. We accept payment by bank transfer or credit card. All prices are in AUD unless otherwise agreed in writing.
8. Intellectual Property
Upon receipt of full payment, you are granted a perpetual, non-exclusive licence to use all delivered assets for your business marketing purposes. You may not resell, sublicense, or transfer the assets to a third party without our written consent. Recommend retains the right to use anonymised excerpts of the work in our own portfolio and marketing materials, unless you request otherwise in writing prior to engagement.
9. Confidentiality
We treat all information shared with us — about your business, your clients, and your strategy — as confidential. We will not share this information with any third party except as required to deliver the service or as required by law.
10. Cancellations and Refunds
If you cancel after an interview has been conducted, you will be invoiced for work completed to that point. If you cancel before an interview is scheduled, a full refund will be issued less any administration costs incurred. Refunds are not available after final assets have been delivered.
11. Limitation of Liability
To the maximum extent permitted by law, Recommend's liability for any claim arising from our services is limited to the amount paid by you for the specific engagement giving rise to the claim. We are not liable for any indirect, incidental, or consequential loss, including lost revenue or reputational harm.
12. Governing Law
These Terms and Conditions are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The version in effect at the time of your engagement applies to that engagement. We will notify you of material changes where reasonably practicable.
